General Terms and Conditions of Sale – Odontoscope System®

Article 1 – Scope

These General Terms and Conditions of Sale (GTCS) apply to all orders of the Odontoscope® System placed with Simon Benoliel – FSBD, manufacturer and distributor. They shall prevail over any client document unless expressly agreed otherwise in writing.
The GTCS may be modified at any time; the applicable terms are those in force on the date of the order.

Article 2 – Products and availability

Offers are exclusively reserved for institutional healthcare facilities (nursing homes, long-term care facilities, facilities for persons with disabilities).
In the event of unavailability, the client will be informed within 15 days and offered either deferred delivery or reimbursement.

Article 3 – Orders

An order becomes binding upon written validation or signature of the purchase order.
The annual subscription to the Odontoscope® System is activated upon receipt of the signed purchase order.

Article 4 – Prices

4.1 Odontoscope® System pricing

The Odontoscope® System is available for €620 excl. VAT, including :

  • two boxes of 10 Odontoscope® devices (i.e., 20 devices),

  • annual access to the Odontoscope® application,

  • access to online training and user documentation.

Each device is intended for individual use and may be reused by the same resident as long as it remains in good condition and clean.

4.2 Additional device orders

Additional devices are sold as follows:

  • €20 excl. VAT per Odontoscope®

  • Sold exclusively in boxes of 10 units (€200 excl. VAT per box)

  • Minimum order: 2 boxes (€400 excl. VAT)

4.3 Application-only access

If the institution wishes to retain access to the application without ordering annual devices, access is offered at a rate of:

€360 excl. VAT per year

4.4 Dental tele-expertise

Dental tele-expertise is performed and certified by dental surgeons practicing in full professional independence, without any relationship of subordination or exclusivity with FSBD, in accordance with the applicable tariffs in each country and subject to the reimbursement conditions established by the relevant health insurance bodies.

Article 5 – Reimbursement by health insurance

The individual medical device Odontoscope® may be re-invoiced to the resident by the institution (MR-S, EHPAD), in the same way as any recognized medical device. Odontoscope® is registered in EUDAMED and bears the CE marking.

In Belgium, Odontoscope® is registered with the Federal Agency for Medicines and Health Products (FAMHP). The Odontoscope® application is approved by the mHealthBelgium platform and may, depending on the case, be partially or fully reimbursed by the resident’s health insurance fund. mHealthBelgium is the official Belgian platform that validates and lists mobile medical applications. It is managed by beMedTech and Agoria, in collaboration with the National Institute for Health and Disability Insurance (INAMI).

Upon request, an invoice issued in the resident’s name can be provided.
Neither FSBD nor Odontoscope® can guarantee reimbursement approval, as this depends on the specific criteria of each health insurance fund.

Article 6 – Payment

Payment shall be made by bank transfer within 30 days following invoice issuance.
Products remain the property of FSBD until full payment has been received.

Article 7 – Delivery

Delivery is free of charge for all orders placed under the annual subscription or for additional device orders.
Products are shipped at the client’s risk once handed over to the carrier.

Article 8 – Returns

Used medical devices cannot be returned or exchanged.
In the event of a defective product, replacement may be offered after validation by the technical department.

Article 9 – Warranty

Odontoscope® is guaranteed against manufacturing defects.
Improper use, physical damage, or unauthorized modifications exclude any warranty coverage.

Article 10 – Personal data

Collected data are processed in accordance with the GDPR and are used exclusively for order management, application services, and tele-expertise activities.

Article 11 – Disputes

These GTCS are governed by Belgian law.
In the event of a dispute, jurisdiction is assigned to the courts of Brussels unless mandatory legal provisions provide otherwise.
